  • To review the tax implications of foreign trusts, differentiating between foreign grantor and non-grantor trusts.

Course Overview

Transfer taxes play a crucial role in the realm of estate planning and wealth transfer, particularly for individuals who are not domiciled in the United States but have assets situated within the country. This comprehensive guide aims to shed light on transfer taxes for American non-domiciliaries, exploring key concepts, applicable laws, and strategic considerations.

This CPE webinar will cover U.S. transfer taxes, emphasizing the distinctive rules for citizens, domiciliaries, and NCNDs. Through hypothetical scenarios and real-world considerations, the document explores the factors that determine tax exposure, such as residency, domicile, and international treaties. It provides detailed insights into how transfer taxes apply to different categories of assets, including real estate, business entities, and financial accounts. Further, we will explore specific aspects of transfer taxes applicable to nonresident individuals. This includes the estate and gift tax exclusions, the taxation of U.S.-situs assets, and the role of estate and gift tax treaties in modifying tax applications.

Major topics discussed:

  • Background Considerations
  • Initial Considerations - Taxpayer Classification
  • United States Transfer Taxes - Classification
  • Nonresident Individuals - Transfer Taxes
  • Foreign Trusts
  • Planning Mechanics

Join this CE Tax webinar to uncover key aspects such as the taxation of foreign trusts, emphasizing the distinction between foreign grantor and non-grantor trusts, and highlighting the "throwback" rule for U.S. beneficiaries.
