Course Description

Retail e-commerce sales in the US reached an estimated $146.20 billion in Q2 2019, accounting for 10.7% of total retail sales (which are estimated at $1.36 trillion), per the most recent figures released by the US Department of Commerce. E-Commerce "Services" such as software, information services, digital products, and SaaS/cloud computing are also on the rise. As an online retailer, you may believe that you don’t have sales tax liability and that you don’t need to worry about nexus or other sales tax issues. Businesses and auditors often find themselves trying to fit new technology and terminology into antiquated rules and definitions.

This webinar will help you to learn about the new multi-state taxation rules for these e-Commerce services. However, there are a number of practices common to e-commerce operations that could generate significant liability for your business – even if you aren’t selling tangible products online. Your sales tax issues can be complex even if you don’t know it.

Highlights of the webinar :

  • To give tax professionals a working knowledge of sales and use taxes as they apply across the US.
  • Learn to identify taxable transactions and how to document nontaxable and exempt transactions.
  • Insights on evolving nexus standards, such as economic nexus, agency nexus, “click-through” nexus, affiliate nexus.
  • To learn about remote seller notice requirements, federal nexus legislation and jurisprudence.

Learning Objectives

  • Articulate industry terminology such as Software-as-a-Service (Saas)
  • Understand what happens if a product uses software to manage a business's confidential information? Is this taxable software, or a nontaxable personal information service?
  • Convey how different fact patterns in different states prompt different e-Commerce tax issues
  • Learn  how to handle e-Commerce services compliance and audit issues
  • Explore the remaining multi-state issues in e-Commerce taxation
