When you’re running a business, it’s not uncommon for things to slip through the cracks. Unfortunately, employment taxes are often one of these things. If you have failed to pay employment taxes when they are due, you are at high risk for a Trust Fund Recovery Penalty.

Speaker Jessie Seaman in this CPE seminar focuses on federal tax filing and deposit requirements if a business issues payroll. Special attention will be paid to corporations taxed under subchapter S of the Internal Revenue Code since a “reasonable wage” requirement exists for many shareholders actively participating in the business.

The online CE/CPE tax course will outline the differences between contract labor and employees so business clients may be counseled on Worker Classification.

Attendees will learn about personal liability through Trust Fund Recovery Penalty (TFRP) assessment for parties that are deemed responsible for payroll deposits. Strategies, IRS process, and timelines for TFRP representation, including the 4180 interviews, will be covered.

  • To analyze a Worker’s Classification as an employee receiving a W-2 or contract laborer receiving a 1099-MISC taxpayer, plus when a shareholder should be paid a “Reasonable Wage.
  • To discuss who may be assessed the Trustfund Recovery Penalty vs. automatic personal liability due to entity structure.
  • To accurately calculate the total Trustfund Recovery Penalty that the IRS may legally assess.
  • To explore the risk of personal assessment to “responsible parties” in the case of a Trust Fund Recovery Penalty.
  • To analyze how to effectively walk a client through the 4180 interviews and the documentation a Revenue Officer will request or summons.
  • To explain the letters 1153 and 2751 regarding the IRS determination of TFRP assessment.

In this CE/CPE seminar, speaker Jessie Seaman will provide instructions for tax professionals representing business taxpayers. She will outline the necessary compliance for each entity type. Participants will know which resolutions are available for BMF cases and which IRS office has jurisdiction.

The Internal Revenue Service has many forms and schedules including Form 433-A and Form 433-B. Form 433-A is an individual collection statement and can be considered an individual financial statement. Whereas Form 433B is a collection of information statements for a business.

This CE/CPE tax session will also cover the preparation of 433-B and 433-A (pages 5-6) for active and dissolved entities. Trustfund Recovery Penalty representation will be covered from investigation to assessment.

Participants will learn how to portray a business client’s income, assets, and liabilities to ensure a formal resolution to pay back taxes is possible for ongoing operations and profitability.

The Fair Labor Standards Act is the granddaddy of all payroll laws. It is intended to protect workers against certain unfair pay practices. As such, the FLSA sets out various labor regulations regarding interstate commerce employment, including minimum wages, requirements for overtime pay, and limitations on child labor. It was passed in 1938 and has seen numerous changes over the years. It is one of the most important laws for employers to understand, as it sets out a wide array of regulations for dealing with employees, whether salaried or paid by the hour.

This online CPE seminar will have a basic overview of the Fair Labor Standards Act and what employers are applicable and what laws the FLSA maintains.

There are two types of employees – "exempt" and "non-exempt." You might've seen these terms on job postings, or heard them in conversation. If you aren't sure what they mean, don't worry. Trying to understand labor laws can be confusing, especially if you’re new to the workforce.

In this CPE session, a review of current exempt versus non-exempt requirements will be reviewed along with activity in the current legislation around changes to the exempt categories.
