This part of the course conveys what is the role of an accountant if the return you prepared comes under the criminal investigation by the IRS. The key roles of an accountant can be defending the taxpayer, attacking the overzealous numbers from the investigation, and as an expert in defending the law.

The Tax Relief and Health Care Act authorized the IRS to create a Whistleblower Office dedicated to investigating, processing, and recovering claims concerning the underpayment of taxes. Under the IRS’ new program, whistleblowers may recover 15 to 30 percent of the amount collected provided the taxes and amounts in dispute exceed $2 million. The IRS whistleblower program allows anyone aware of tax underpayments to apply for a whistleblower award using IRS form 211. The IRS reviews the submission and determines what action should be taken. As a part of the process, the whistleblower may be interviewed for more information and if such information leads directly to a recovery of at least $2 million including interest and penalties, the whistleblower is entitled to compensation. After the completion of a successful investigation, the IRS whistleblower office provides the whistleblower with an award determination. The webinar explores this as an additional revenue-building opportunity for the accountants. 

The IRS and many states have a program called Voluntary Disclosure, wherein an individual or organization can come forward and volunteer information before the situation worsens for nonpayment of taxes or filing pending returns. How an accountant can help their clients in avoiding a wide variety of civil and criminal sanctions that may be imposed on them for not complying with the tax law.
