By using the Website or Mobile Application -- whether on iOS or Android -- you agree to the following terms and conditions (the “Terms and Conditions“) and to myCPE Privacy Policy, which may be accessed at Privacy Policy. If you do not agree to these Terms and Conditions, you should not use the Site or Mobile Application. We may modify or amend these Terms and Conditions at any time so you should bookmark this page and check it often. use of myCPE's site or website or undertaking its services constitutes your acceptance of these terms and conditions. By sending us such submissions, you agree that such submissions shall be owned by myCPE, and, unless otherwise explicitly agreed in writing, myCPE shall have no obligation to compensate you for the submissions and may use the submissions for its own use in its sole discretion.

All intellectual property found on the Site, including, without limitation, trademarks, service marks, logos, written content, videos, webinars, presentations, and copyrighted material are the property of myCPE or it licensors or other partners or third parties. Except as explicitly stated herein, you are not granted any license or other right to use such intellectual property without the prior written consent of myCPE or the applicable third-party owner. A lot of written content on our site or mobile application such as presentation title, course description, learning objectives, subject, presentations, hand-outs, contents, links, blogs, or any other content may be taken from public sources or authored by our presenter or speakers or provided by the partner or presenter or speaker. Except as required by NASBA & IRS regulations we haven't done any independent verification or due diligence. However all such content shall be solely owned by myCPE.

User Information and Content policy

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials ("Content"), is collected from the users, presenters, companies, speaker or other associated parties whether publicly posted or privately transmitted, are the sole responsibility of the person or entity from which this Content originated, myCPE by no means independently verifies the information nor is responsible to do so. This means respective parties (user, presenter, speaker, etc.) and not myCPE, are entirely responsible for all Content uploaded, posted, emailed, shared or otherwise transmitted via the Service.

myCPE does not control the Content posted via the sit or mobile app and, as such, does not guarantee the accuracy, integrity or quality of this Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable.   • Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;

  • "Stalk" or otherwise harass another; or
  • Collect or store personal data of other users.
  • You acknowledge that myCPE does review webinar's content as per the requirement of NASBA or IRS but doesn't pre-screen any other content like user information, testimonial etc, but that myCPE and its designees shall have the right (but not the obligation) in their sole discretion to refuse or move any Content that is available on the website or on the mobile application. Without limiting the foregoing, myCPE and its designees shall have the right to remove any Content that violates these terms and conditions or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with the use of any content, including any reliance on the accuracy, completeness, or usefulness of the Content.


You acknowledge and agree that myCPE may record or preserve Content and may also disclose Content if required to do so by law or in the good faith that this preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these terms and conditions; (c) respond to claims that any Content violates the rights of third-parties; or (d) protect the rights, property, or personal safety of myCPE, its users and the public.

Advertisement or Marketing or Endorsement

Any advertisement on myCPE or any kind of marketing or any affirmation or endorsement on myCPE by any party or presenter or sponsor or company does not warrant, endorse or guarantee any Products or services on our Site, and we will not be a party to any transaction between you and any advertiser or user. Continuing education content is reviewed in accordance with regulations however there is always implied exposure to company, brands, products, services during the continuing education. myCPE shall not assume any responsibility with respect to the same. myCPE does not assume the responsibility of enforcing licensing requirements, or of checking for license, with respect to licensed professions or trades, prior to publishing advertisements. myCPE does not assume the responsibility of monitoring the use of trademarks, copyrights or other rights of third parties.

Registration of Webinars, Conferences, and other Courses

User registering for the webinars or self-study videos or conferences or any ebooks or literature or for any other purposes and have provided contact information and data including his email ids, contact numbers, reviews & comments, questions, testimonials etc. during and after each course may be shared with the presenters & companies and/or to the sponsor of the courses or any other parties as may be needed from time-to-time, for which the attendee has registered for their individual marketing purposes. myCPE does not control how this data is used once it has been provided. By registering for and participating in webinars, self-study videos and audio conferences through the Site, you acknowledge that myCPE may record such sessions and that you consent to such recording and myCPE use of those recordings for promotional, training or any other purposes. Some webinars are being offered through their early recordings. However, presenter are available to answer your queries. In case of unavailability of the presenter, your questions would be redirected to the presenter within 24 Hours.

Termination of Access

You agree that myCPE, in its sole discretion, may terminate your password, account (or any part thereof) or use of the Service, and remove and discard any content within the Service, for any reason, including, without limitation, for lack of use or if myCPE believes that you have violated or acted inconsistently with the letter or spirit of these terms and conditions or against the interest of public or myCPE. myCPE may also in its sole discretion and at any time discontinue providing the service, or any part thereof, with or without notice. You agree that any termination of your access to the service under any provision of these terms and conditions may be affected without prior notice, and acknowledge and agree that myCPE may immediately deactivate or delete your account and all related information and files in your account and bar any further access to such files or the Service. Further, you agree that myCPE shall not be liable to you or any third-party for any termination of your access to the Service.

Third Party Links or Tools or Usage of Third-Party tools

The website (www.my-cpe.com) contains links to other websites. myCPE approval or allowance of such links indicates no endorsement by myCPE to such third-party websites, services, products, policies or other information. myCPE is not responsible for, and cannot control the content of those third-party websites. By using the Site, you agree that you will not attempt to hold myCPE responsible or liable for the content of such third-party websites. myCPE uses third party tools to provide services through it's site and mobile such as zoom, Vimeo, Push Notification or any other services and while doing so it may provide user information including personally identifiable information to this third party services providers.

Limitation of Liability

You expressly understand and agree that myCPE and its parents, subsidiaries, affiliates, agents, officers, trustees, members, managers, partners or employees will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with

Illegal Activities

The use of myCPE service for any illegal activities is prohibited. Illegal activities include, but are not limited to, tampering with information databases and software, unauthorized entry to other networks or computers, trafficking in illegal products or substances, disobeying trade restrictions, violating civil rights laws or knowledgeable vandalism or destruction of online files. You shall comply with all applicable laws, statutes, ordinances and regulations regarding your use of our Service.

Security and Passwords

You will set a password and account designation for using the service & registration process or you may login through third party website like Facebook, Google, LinkedIn or other. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify myCPE of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. You may not disclose or share your password to any third parties or using your password for any unauthorized purpose. myCPE cannot and will not be liable for any loss or damage arising from your failure to comply with this paragraph.

Indemnification

You agree to defend, indemnify and hold us and our affiliates, directors, officers, members, managers, agents, consultants and employees harmless from and against any and all claims, losses, liabilities, costs and expenses (including, without limitation, attorneys' fees) arising from your violation of any of these terms and conditions or any third-party rights, including, without limitation, infringement of any copyright, violation of any proprietary right and invasion of any privacy rights.

Copyright Complaints or Infringements

It is myCPE's policy to comply with all intellectual property laws and, in appropriate circumstances, to terminate the accounts of users who infringe the intellectual property rights of others. If you believe that your work has been infringed, please send us a notice of copyright infringement containing the following information to cpa.valay.parikh@gmail.com

  • Physical or electronic signature of the copyright owner or the person authorized to act on behalf of the copyright owner;
  • Identification of the copyrighted work claimed to be infringed;
  • Description of where the alleged infringements are located in the Service;
  • Your name, address, telephone number, and email address;
  • A statement of good faith belief that the material is infringing;
  • A statement that the information in the notification is accurate and that the complaint is authorized by the copyright holder.

Once proper notice has been received, myCPE may take the following action:

  • my-cpe.com will remove or block access to infringing material; and
  • my-cpe.com will notify the subscriber of the copyright infringement notification.

The subscriber may provide a counter notice that contains the following information:

  • Physical or electronic signature of the subscriber;
  • Identification of the material that has been removed or to which access has been disabled;
  • Statement that the subscriber has a good faith belief that the material did not constitute copyright infringement;
  • Subscriber's name, address, telephone number, and email address; and
  • Statement that the subscriber consents to jurisdiction in federal court.

If myCPE receives a counter notification, it will forward this notification to the original complaining party. If the complaining party does not respond to the counter notice by filing a lawsuit, myCPE will restore the material or access to the material within 10 to 14 days of the receipt of a counter notification.

These Terms and Conditions and myCPE Privacy Policy constitutes the entire agreement between you and myCPE with respect to your use of the Website and Mobile Application. You may not assign or delegate any of your rights or obligations under these Terms and Conditions.

Rebroadcast Terms

If case live webinars are being rebroadcasted, i.e., live webinars are done by way of recording of the old webinar, still, we will have a presenter or any other competent professional on the panel to answer your questions. Unlimited Access Subscription

The myCPE Unlimited Access Exclusive Subscription provides Users with access to all content on the platform that is eligible for continuing education, with the exception of Preparation courses, which are available separately at a different price.

Users will have access to a wide range of high-quality continuing education courses, covering various topics and industries. The subscription is designed to be user-friendly and flexible, allowing Users to learn at their own pace and on their own schedule. All content can be accessed online from anywhere in the world.

Please note that Preparation courses are excluded from the subscription and are available separately at a different price. These courses are designed specifically to help Users prepare for particular exams or certifications and are not included in the myCPE Unlimited Access Exclusive Subscription.

With effect from February 25, 2023, all Users of myCPE Unlimited Access Prime Subscription are being upgraded to myCPE Unlimited Access Exclusive Subscription. This means that these users will be able to access all the content available under myCPE Unlimited Access Prime Subscription, as well as qualifying courses and advance certification programs which are only available with myCPE Unlimited Access Exclusive Subscription.

Subscription Fees

The Unlimited Access Exclusive subscription requires payment of an annual fee. The fee amount and payment terms will be clearly displayed on our website.

Membership

The Unlimited Access Subscription is for your individual/ team/ company use and its employees and is non-transferable. Your MyCPE Subscription will continue until terminated. To use the MyCPE service you must have Internet access and a MyCPE ready device, and provide us with one or more Payment Methods. “Payment Method” means a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with a third party. Unless you cancel your subscription before your billing date, you authorize us to charge the subscription fee for the next billing cycle to your Payment Method (see "Cancellation" below).

Free Trial 

Users will need a current, valid payment card or bank details to sign up for Unlimited Access Subscription. While users won't be charged for your free trial, you will be automatically charged converted to a paid membership plan at the end of the trial period and will be renewed annually. You can cancel anytime from your dashboard. Once charged, the transaction will be considered final and no refund shall be granted thereafter.

Billing Cycle

The subscription fee for the MyCPE unlimited access and other charges such as taxes and possible transaction fees, will be charged to your Payment Method on the specific payment date indicated on the "Account" page.

Payment Methods

To use the MyCPE Unlimited Access services you must provide one or more Payment Methods. You authorize us to charge payment through any payment method associated with your account in case your primary payment method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid payment. For some payment methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details. myCPE still has rights to recover it's dues as per terms and conditions mentioned here in even though credit card or payment gateway issues you refund on your chargeback request from our bank account.

Updating Payment Methods

You can update your Payment Methods by going to the "Account" page. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge through the applicable Payment Method(s).

Change in the Price and Subscription Plans

The subscription fees for myCPE Unlimited Access Exclusive Subscription may be revised by us. We will notify all Users of any price revision at least 30 days prior to the effective date of the revision by sending a price revision email to the email address provided by the User.

In case a User does not agree to the revised subscription fees, they may cancel their subscription by logging in to www.my-cpe.com > User Dashboard > Unlimited Access > Cancel Auto Renewal of Subscription or by sending an email to support@mycpe.com. If we do not receive any reply from the User within 7 days, the new rates will be applicable from the next renewal cycle.

Please note that if a User has subscribed to myCPE Unlimited Access Exclusive Subscription during offers or discounts, they may have signed up at a lower initial subscription price. However, the subscription price after 12 Months during any automatic renewal term will be the "Undiscounted Original Price" of the respective subscription that the User has signed up for, or subsequent price increase that has been notified from time to time. We will send an auto-renewal reminder email with pricing to the User prior to the end of the current subscription term.

We recommend all Users to keep their contact details up to date to ensure they receive any important notifications regarding subscription fees or other matters.

We want to ensure that our users are satisfied with the services provided by our platform. In the unlikely event that a user is not satisfied, we have established the following refund policy

Refund Eligibility

Users are eligible for a refund for the following reasons
  • If they have paid for a subscription or service on our platform and have experienced technical issue that could not be resolved by our support team.
  • If we receive payment more than once  owing to a technical error at the time of purchase or renewal of subscription, the additional amount collected would be eligible for a refund.
  • In the case where refunds are approved, myCPE shall have the right to deduct the transactional charges of $10.00 and make the balance payment to the users.

Timeframe for Refunds

Refunds will be considered within 30 days of the purchase date.

Refund Request Process

Users must submit a request for a refund via email to our support team at support@my-cpe.com

  • The refund request should include the following information:
  • User's name and contact information
  • Subscription or service details
  • Reason for the refund request
  • Any supporting documentation that would assist in the evaluation of the request.Refund Evaluation

Our support team will evaluate the refund request and determine its eligibility. If the refund request is approved, our team will process the refund and notify the user via email. Refunds will be made to the original payment method used for the purchase and refund will never exceed the actual payment collected.

Refund exceptions

Refunds will not be granted in the following cases:

User failed to stop auto renewal of the transaction before the due date. We have practice of sending reminder email before 7 days of renewal due date. Click here to view the self-serve option to stop auto renewal.

  • The quality or presentation of the content is not good as myCPE is a technology platform that connects educators and learners, myCPE specifically doesn’t take responsibility for any of the content provided by the educator or presenter
  • If a webinar or course is cancelled or withdrawn,
  • Minor errors/technical glitches in the platform
  • Grammatical errors or Incorrect Review questions.
  • Video pauses or buffering etc.

And such other minor issues don’t directly affect the significant functionalities provided under the subscription plan. Refunds will not be granted if the user has requested a refund beyond the 30-day timeframe.

Cancellation & Auto Renewals 

The myCPE Unlimited Access Exclusive subscription is a recurring subscription that shall be auto-renewed on the completion of the subscription term. The subscription is valid for 12 Months from the date of purchase.

  • You may cancel your subscription at any time before the renewal date by in to www.my-cpe.com > User Dashboard > Unlimited Access > Cancel Subscription.
  • Cancellation requests made before the renewal date will result in the cancellation of the auto-renewal feature for the next subscription term.
  • No refunds will be given for any unused portion of the current subscription term.
  • Your subscription will be automatically renewed on the completion of the subscription term unless you cancel your subscription.
  • We will charge the applicable subscription fee to the payment method on file at the time of renewal.
  • You agree to keep your payment information up to date to ensure uninterrupted access to our platform.
  • We reserve the right to change the subscription fee at any time, and we will notify you of any changes before your next renewal date.

Cancellation

Policy Updates

This refund policy may change from time to time. All changes to the policy will be posted to the website and are effective as of posting.

Refund Timing

Qualifying refunds will be processed within seven (7) business days of request for refund. If the original payment was not made by credit card (e.g. made by check or wire), the refund may take more than seven days to process. A requester will be notified as quickly as commercially practicable if his or her request for refund does not qualify or fall under MyCPE refund policy.

Inclusions and Offers

You may attend any live event scheduled during your subscription period, and included in your subscription. Registrations for each scheduled events are available until the start time of the program. Team Membership

This Subscription is for your Team/ organization use and its employees and is non-transferable. Your myCPE Subscription will continue until terminated. To use the myCPE service you must have Internet access and a myCPE ready device, and provide us with one or more Payment Methods. “Payment Method” means a current, valid, accepted method of payment, as may be updated from time to time, and which may include payment through your account with a third party. Unless you cancel your subscription before your billing date, you authorize us to charge the subscription fee for the next billing cycle to your Payment Method (see "Cancellation" below).

Free Trial 

Users will need a current, valid payment card or bank details to sign up for myCPE teams. While users won't be charged for your free trial, they will be automatically charged converted to a paid membership plan at the end of the trial period and will be renewed monthly. You can cancel anytime from your dashboard. Once charged, the transaction will be considered final and no refund shall be granted thereafter. 

Team Users

Team Users are broadly classified in to three categories: Administrator, Manager and Staff. rights are mentioned hereunder -

  1. Administrator (Admin) :
    • Exclusive right to allocate staff to supervisor
    • Rights for Adding more users
    • Right to Allocation of courses
    • Rights of Managing and tracking learning of staff
  2. Supervisor :
    • Right to Allocation of courses

  3. Staff :
    • Take any course on the website for their learning and continuing education

Seat Allocations and Deletions

Administrators of the teams have exclusive rights to add/remove users. Signing up for myCPE is absolutely free, but if you want to add users (buy seats), you need to make payment and buy seats. Administrators of the teams have the right to delete (Remove) the user (Staff/ Supervisor). Users will be moved to the category of "Inactive User" until the subscription for that user does not end for the relevant tenure. Admin also has the right to add back the deleted user and make the profile active again. Deleted staff members remain users of myCPE. However, their Unlimited Access Rights are terminated. They need to pay for taking courses.

Non-transferability of seats

Once added and assigned a seat to a particular staff member, it is non-transferable to any other staff member as continuing education credits are distributed in a specific user's name throughout the year. Administrators of the teams have the right to delete the user (Staff/ Supervisor). After deletion, the user will be moved to the category of "Inactive User" until the subscription for that user does not end for the relevant tenure. We will notify the user via email that he has been removed from the Team's network on myCPE. The rationale behind non-transfer is that we register staff members with their qualifications, and credits are issued only in registered names; otherwise, the purpose of continuing education credits will not be met.

Billing Cycle

The subscription fee for the myCPE unlimited team access and other charges such as taxes and possible transaction fees, will be charged to your Payment Method on the specific payment date indicated on the "Account" page.

Payment Methods

To use the myCPE team Unlimited Access service you must provide one or more Payment Methods. You authorize us to charge payment through any payment method associated with your account in case your primary payment method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account, we may suspend your access to the service until we have successfully charged a valid payment. For some payment methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details. myCPE still has rights to recover it's dues as per terms and conditions mentioned here in even though credit card or payment gateway issues you refund on your chargeback request from our bank account.

Updating Payment Methods

You can update your Payment Methods by going to the "Account" page. We may also update your Payment Methods using information provided by the payment service providers. Following any update, you authorize us to continue to charge through the applicable Payment Method(s).

Change in the Price and Subscription Plans

We may change our subscription plans and the price of our service from time to time; however, any price revision to the subscription pricing shall be made by sending the price revision email to the users. Refunds for Team subscriptions

myCPE provides an online continuing education platform to professionals for 100+ Qualifications approved by several regulatory bodies. myCPE Unlimited Access subscription plan for a team/company is available for  $299 annually. This subscription gives your staff unlimited access to courses on our platform for 12 Months from the date of subscription, and it is a recurring subscription that shall be auto-renewed on the completion of the year.

MyCPE shall not be able to provide any refund once the subscription has been purchased or auto-renewed unless there is a specific default in providing services from the side of myCPE and the user can provide the same in writing with a valid and reasonable explanation. Furthermore, if we receive payment more than once  owing to a technical error at the time of signing up or renewal, the additional amount collected would be eligible for a refund. We always encourage users to be careful and read all the terms before signing up. You further agree that this is the complete and exclusive agreement between us, and this Agreement supersedes any proposal or prior agreement, whether oral or written and any other communication between us relating to the subject matter of this Agreement.

Referral-Affiliate Program
By participating in the myCPE Influencer, Referral-Affiliate Program ("the Program"), you agree to the following terms and conditions:
Eligibility: The Program is open to individuals and companies who meet the requirements set by myCPE. Participants must be at least 18 years old or of legal age in their jurisdiction.
Commission and Payments: Participants will earn a commission of 10% on each subscription generated through their unique affiliate link. Commissions will be paid on a monthly basis, subject to a minimum payout threshold determined by myCPE. Payments will be made via the selected payment method provided during registration.


Refund: Incase of refund initiated by the subscriber under any circumstances, the commission for that subscriber will either be not paid or in event of after the commission is paid it will taken up in the next payment cycle (less from the current month count).

Confidentiality: Participants agree to keep confidential any non-public information shared by myCPE, including but not limited to customer data, pricing information, and marketing strategies. Participants shall not disclose such information to any third party without the prior written consent of myCPE.
Termination: myCPE reserves the right to terminate the participation of any participant in the Program at its sole discretion, without prior notice, if the participant violates any of the terms and conditions outlined herein.


Limitation of Liability: myCPE shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the Program, including but not limited to loss of profits, data, or business opportunities.


Modification of Terms: myCPE reserves the right to modify or update these terms and conditions at any time without prior notice. Participants are responsible for regularly reviewing the terms and conditions for any changes.


Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction where myCPE is headquartered.
Entire Agreement: These terms and conditions constitute the entire agreement between the participant and myCPE regarding the Program and supersede any prior agreements or understandings, whether written or verbal.
