Course Description

New sales tax nexus standards are creating a larger compliance footprint for U.S. companies and, potentially, foreign entities selling into the United States. With the change from physical presence to economic nexus, states have become more aggressive in identifying and requiring entities to comply with sales tax collection and filing rules, as well as income tax if applicable. Sales tax economic nexus is here to stay, and this CPE course investigates what this means for companies and identifies potential legal arguments in this new area of tax jurisprudence.

The Multistate Voluntary Disclosure Program (“MVDP”) provides a way for a taxpayer with potential tax liability in multiple states to negotiate a settlement, using a uniform procedure coordinated through the National Nexus Program (“NNP”) staff of the Multistate Tax Commission (“Commission”). The Commission offers this service to encourage taxpayers to commence filing and paying taxes in states in which they may have substantial nexus, which is the connection between the taxpayer and the state arising from the taxpayer’s activities in that state, making the taxpayer subject to the state’s taxing authority

A taxpayer with potential tax exposure in more than one state will find this service to be an efficient tool in seeking voluntary disclosure with participating states.  There is no charge to the taxpayer for participation in the MVDP.
