New arrivals, both Immigrants and refugees, may have little information about how to handle their U.S. tax situation. During their first two tax years in the U.S., they may face unusual income tax return procedures or foreign information reporting requirements & forms. Some tax professionals well-intentioned assistance organizations or sponsors may not be able to provide expert guidance.
How the new arrival qualifies to enter the U.S. may be less important than their past and current economic activities.
New immigrants may become U.S. residents by holding an immigration visa. Or they may enter the U.S. on another visa type and become a tax resident by meeting the Substantial Presence Test (SPT).
Those who obtained a Diversity Immigrant U.S. Visa through the ‘visa lottery’ were not sponsored for that visa by a U.S. person. If they were not already in the U.S. on a different visa when they won the visa lottery, they may have no insights into the U.S. income tax system. Special immigrant visa holders will not have encountered the U.S. tax system while they were USG employees, or worked with the U.S. or international organizations.
