  • Recognize the boundary between permissible financial analysis and the unauthorized practice of law in client communications.
  • Evaluate conflicts of interest that may arise in neutral and retained-side divorce financial engagements.
  • Assess confidentiality and data-security obligations in a virtual, multi-state divorce financial practice.
  • Apply a structured ethical decision framework to challenging client and professional scenarios.
  • Explain when professional competence limits require referral to attorneys, tax professionals, actuaries, business appraisers, or other specialists.

Course Overview

Divorce financial professionals work in one of the most emotionally charged and financially significant areas of client service. In this environment, professional boundaries, objectivity, confidentiality, and sound judgment are essential to maintaining trust and protecting both clients and the profession.

This course examines the seven principles of the Institute for Divorce Financial Analysts (IDFA) Code of Ethics and Professional Responsibility and applies them to real-world divorce financial practice. Participants will explore the boundary between financial analysis and legal advice, competence and referral decisions, conflicts of interest, neutrality versus retained-side analysis, confidentiality and data security, ethical marketing, and professional accountability. Practical scenarios demonstrate how ethical issues can arise when professionals are under pressure to advocate, predict legal outcomes, handle sensitive client information, or work alongside financial planning and investment relationships.

Major Topic:

  • IDFA Code of Ethics and Professional Responsibility
  • Financial analysis versus legal advice
  • Competence, professional limits, and referrals
  • Objectivity and conflicts of interest
  • Confidentiality and data security
  • Compliance, reporting, and accountability

Through scenario-based examples and a structured ethical decision framework, participants will learn how to recognize situations that may exceed their professional role, disclose and mitigate conflicts, safeguard confidential information, document difficult decisions, and refer matters to the appropriate specialist when needed. The course is designed to help divorce financial professionals make defensible, ethical choices while preserving the credibility of their work and the trust placed in their credential.
