Introduction

This Terms of Use Agreement (“Agreement”) governs your access to and use of the Mobile App (“App”) available on the Google Play Store, IOS App Store, which is owned and operated by Company, a limited liability partnership incorporated under the laws of India (“Company”, “we”, “our”, or “us”). The mobile app is a mobile learning platform developed and operated by the Company to provide seamless access to continuing education courses for accounting, tax, finance, HR, and related professionals. Access to the educational content within the App is exclusively available to active subscribers of the company. The App is designed to offer on-the-go learning through interactive videos, audio content, live webinars, and other CPE-compliant resources, helping professionals meet their compliance requirements anytime, anywhere. 

By accessing, browsing, registering with, or using the App, you agree to be bound by this Terms of Use, including the Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, please do not use the App or any Services. 

Eligibility & Access

You represent that: 

  • You are at least 18 years old, or if under 18, you are using the App under the supervision of a parent or legal guardian. 
  • You are legally capable of entering into binding contracts under applicable laws. 
  • You have provided accurate and complete information while registering on the App.

If you are using the App on behalf of an organization, you confirm that you are duly authorized to accept this Agreement on its behalf. 

Services Offered

The App provides users with continuing professional education services, including access to online courses, videos, articles, assessments, certifications, and related educational resources (collectively, “Services”). These Services are offered to individuals and institutions and may be free or chargeable depending on the specific offering. 

Details of our Services, including features, pricing, and access, are provided on the App and may be updated from time to time. 

User Accounts

To use certain features of the App, including continuing education content, you must create an account by providing accurate personal and professional information. Access to educational resources within the App is restricted to users with an active subscription (“Subscribers”)., you may be required to create an account by providing personal and professional information. You are responsible for: 

  • Maintaining the confidentiality of your account credentials. 
  • All activities that occur under your account, whether authorised by you or not.

We reserve the right to suspend or terminate your account, without notice, if we suspect any unauthorized, fraudulent, or inappropriate use, including access without an active subscription. 

Mobile App Functionality Disclaimer

The Company offers access to the Platform through its official mobile application as a convenience for users. While we endeavor to ensure that the mobile app is functional, secure, and compatible with commonly used devices and operating systems, we do not warrant or guarantee that the mobile app will operate without interruptions, errors, defects, or performance limitations. 

Use of the mobile app is at your own risk. The Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your access to, use of, or inability to use the mobile app, including but not limited to issues caused by system errors, temporary downtime, feature malfunctions, software bugs, or incompatibility with specific devices or operating systems. 

All mobile app access and subscriptions are provided on an “as-is” and “as-available” basis. The Company does not offer refunds or credits for any subscription fees, access charges, or related costs incurred due to mobile app functionality issues, except as expressly provided in our Refund Policy, if applicable. 

Users are encouraged to report any bugs, errors, or usability concerns through the appropriate support channels provided within the app or on the Platform. While the Company will make reasonable efforts to address such reports in a timely manner, no assurances are made regarding resolution timeframes or continued availability of app features. 

App Store Terms Apply

You acknowledge that the availability of the App depends on third-party stores such as the Apple App Store and Google Play Store, and your use of the App may be governed by the terms of service of such Apps. You agree to comply with any applicable terms from those third-party providers. 

Data and Internet Charges

You are solely responsible for any data or internet charges incurred while using the App. We recommend the use of Wi-Fi when streaming video content or downloading large files. 

Offline Access and Syncing

Offline access may be provided for certain content, which remains subject to licensing restrictions. Offline content may expire or become inaccessible without notice. 

Push Notifications

Upon installing the App, you may receive push notifications. You may manage your notification preferences through your device settings or within the App. 

Device Compatibility

We do not guarantee that the App will function on all devices or operating systems. You are responsible for ensuring your device meets minimum system requirements. 

App Uninstallation

You may uninstall the App at any time using your device’s standard procedures. Please note, this does not delete your online account unless explicitly requested via email to support@my-cpe.com.   

Device Permissions

Certain features of the App may require access to your device’s storage, camera, or location. Access is only granted upon your explicit permission and used solely for the stated purpose. 

Personally Identifiable Information (PII)

We collect and process PII (e.g., name, email, course activity) only for legitimate purposes. We implement strict security controls and do not sell or share PII with unauthorized third parties. Use of the App implies consent to our Privacy Policy. 

Third-Party Links

The mobile application may contain links to third-party websites, services, or resources that are not owned or controlled by the Company. These links are provided solely for your convenience and reference. The inclusion of any such link does not imply any affiliation, endorsement, approval, or recommendation by the Company. 

You acknowledge and agree that the Company is not responsible or liable for the availability, accuracy, content, policies, or practices of any third-party websites or services. Your access to and use of third-party links is entirely at your own risk and subject to the terms and conditions and privacy policies of the respective third-party providers. 

We encourage you to review the applicable policies and practices of any third-party sites you visit through the mobile app. The Company disclaims all responsibility for any harm, loss, or damages arising from your interaction with or reliance on any third-party content, products, or services. 

License and Intellectual Property

All materials on the App, including but not limited to software, content, layout, graphics, videos, assessments, logos, and trademarks (“App Content”), are the intellectual property of the Company or its licensors. 

You are granted a limited, non-exclusive, non-transferable license to access and use the App and App Content for personal, non-commercial, educational purposes only. You shall not: 

  • Copy, reproduce, or distribute App Content without prior written permission.
  • Modify or reverse-engineer any part of the App or its Services.

User Content

You may upload or submit content as part of your use of the App (e.g., feedback, course materials, responses). You represent and warrant that: 

  • Your content does not infringe the rights of any third party. 
  • Your content is not unlawful, abusive, defamatory, or otherwise objectionable.

You grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content for the purpose of providing and improving our Services. 

Prohibited Activities

You agree not to: 

  • Use the App for unlawful or fraudulent activities. 
  • Attempt to gain unauthorized access to any part of the App or its systems. 
  • Upload malicious code, viruses, or engage in activities that disrupt App operations.
  • Use automated scripts to collect data or interact with the App. 
  • Misrepresent your identity or professional credentials. 

Violations may lead to suspension, termination, and legal consequences. 

Payment Terms

Certain Services on the App may be chargeable. By purchasing any Service, you agree to: 

  • Pay all applicable fees, including taxes, as listed at the time of transaction. 
  • Use only authorized payment methods.

Payments are processed via third-party payment gateways. The Company does not store or handle your payment information directly. All fees are non-refundable unless otherwise stated by the Company.  

Please note: Pricing for Services purchased through the Mobile App may be higher than prices listed on our website due to additional platform fees or policies imposed by third-party app stores (e.g., Apple App Store, Google Play Store). By making purchases through the App, you acknowledge and accept such pricing differences. 

Privacy Policy

By using the App, you consent to the collection, use, and disclosure of your personal information in accordance with our Privacy Policy, which is incorporated by reference into this Agreement. 

Limitation of Liability

To the maximum extent permitted by law, company shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to: 

  • Use or inability to use the App; 
  • Errors or inaccuracies in content; 
  • Unauthorized access to your data or account. 
  • Device incompatibility; 
  • App errors, bugs, or crashes; 
  • Missed deadlines due to App unavailability.

Our total liability shall be limited to the amount paid by you (if any) for the Services giving rise to the claim.
