  • To discuss how to draft dispute resolution agreements and/or contract provisions that protect client interests if live proceedings are unavailable or undesirable so that clients have more control over how virtual trials and arbitrations proceed.
  • To analyze how to address procedural issues with opposing counsel and establish effective protocols for discovery, hearings, and argument for virtual proceedings.
  • To explain how to prepare for, conduct, and defend depositions and witness testimony in virtual proceedings when the witness is in a different location, including how to handle exhibits without sharing information or strategy prematurely.
  • To analyze how to prepare clients and witnesses to present effectively and use technology to their best advantage.
  • To inspect how to assure that you are facile with technology, preserve confidentiality’s and don’t embarrass yourself or your client with easily avoidable mistakes.

Course Overview

Over the past two years, many litigations and arbitrations have been conducted virtually with the participants in multiple locations convened on a virtual platform. Given the ubiquity of virtual proceedings and the cost savings or avoiding travel by counsel, parties, and witnesses, this process is likely to continue even when it is no longer a health necessity.  

Under these circumstances, lawyers should be working with clients to revise their dispute resolution agreements to memorialize the rules to be followed if a virtual proceeding is needed. Leaving this to chance will invite additional disputes and may put procedural issues in the judge’s or arbitrator’s control that could be anticipated and agreed upon by the parties. 

The issues may include how to conduct depositions remotely, how to handle evidence, whether witnesses can be in the same room as counsel even if opposing counsel and the judge or arbitrator are elsewhere, how to use technology effectively, and a myriad of other issues. Some lawyers are accustomed to doing this live but less confident in a remote setting.
